On July 26, the first training session for Jiangsu IP law enforcers was held in Nanjing. Mao Jinsheng, a Level I Bureau Rank Official of the Intellectual Property Rights Protection Department of China National Intellectual Property Administration (CNIPA), participated in the opening ceremony and delivered lectures, and Zhi Suping, Director of the Intellectual Property Office of Jiangsu Province (JSIPO) gave the kick-off speech.
Zhi Suping said that Jiangsu is facing new challenges to IP protection amidst formidable tasks in COVID-19 prevention and control, economic downturn, and an unstable and complex international environment. To protect intellectual property is to protect innovation, as noted by President Xi Jinping. The CPC Jiangsu Provincial Committee and Jiangsu Provincial People's Government have placed a high priority on IP protection since the 14th Five-Year Plan was unveiled. They have issued a number of policies, including the 15-year Plan (2021-2035) for Developing Jiangsu into a Leading Province in Intellectual Property, the Plan of Jiangsu for Intellectual Property Development During the "14th Five-Year Plan" Period, and the Jiangsu Patent Award Selection Method, outlining a blueprint for IP development and IP protection tasks in Jiangsu. IP protection is a great responsibility and a noble cause. Administrative protection is a crucial part and means of IP protection in China, particularly this year with the upcoming 20th National Congress of the CPC. It is of special significance to protect IP this year. In order for the public to experience justice and fairness in every case, administrative IP law enforcers throughout Jiangsu must enforce laws in a strict, fair, and procedure-based manner, and strive to enhance their capacity for law enforcement.
Zhi Suping requested the participating administrative IP law enforcers to seize on the opportunity to fully engage their thinking and hone their theoretical knowledge and practical skills in order for them to put theories into practice and improve law enforcement capabilities. Participants were also required to comply with the COVID-19 prevention and control requirements, observe the training discipline, and maintain proper training and learning order. After the training, they should return to work with a greater sense of duty, always keep their responsibilities in mind, bravely shoulder their responsibilities, take the initiative to act, blaze new trails, enforce laws and handle cases seriously, and raise the bar for IP protection in Jiangsu.
This training includes lessons on determination of patent infringement, administrative adjudication proceedings for patent disputes, determination of trademark infringement, recognition and protection of well-known trademarks, mediation of IP disputes, operation of the law enforcement system, and law enforcement documentation management and review. IP experts and scholars from China National Intellectual Property Administration (CNIPA), and universities and courts in Jiangsu were invited to give the lessons.
The training is organized by the Intellectual Property Office of Jiangsu Province (JSIPO) and undertaken by the School of Intellectual Property of Nanjing University of Science and Technology. More than 110 IP law enforcers from all prefecture-level cities and counties (county-level cities, districts) in Jiangsu participate in the training.
